Terms of Service

These Terms of Service are an agreement between you and Mohamed Amjad Sharif, a sole proprietor trading as Krutna ("Krutna," "we," "us," or "our"). They govern your access to and use of Krutna's websites, applications, digital business cards, contact-management tools, team features, and related services (the "Service").

By creating an account or using the Service, you agree to these Terms. If you use Krutna for an organization, you confirm that you have authority to bind that organization. If you do not agree, do not use the Service.

1. The Service

Krutna helps individuals and organizations create, manage, and share digital business cards and professional contact information. Depending on your plan and configuration, the Service may include QR-code sharing, NFC-compatible links, lead capture, contact management, analytics, team administration, email signatures, wallet passes, translations, and AI-assisted features.

Features may change as the Service develops. We may add, modify, limit, suspend, or discontinue features. We will give reasonable notice where a material change adversely affects a paid subscription, unless urgent security, legal, or operational reasons prevent us from doing so.

2. Eligibility and accounts

You must be at least 16 years old, or the minimum age required to consent to online services in your country, to create an account. If you are not old enough to enter a binding contract, a parent or legal guardian must agree on your behalf.

You must provide accurate information, keep your credentials secure, and promptly notify [email protected] if you suspect unauthorized access. You are responsible for activity under your account except to the extent caused by Krutna's breach of these Terms or applicable law.

Organization owners and administrators may manage members, cards, settings, and organization data. If an organization provides your account, its administrators may control or remove your access.

3. Your content and contacts

You retain ownership of text, images, contact details, files, and other content you submit to Krutna ("User Content"). You grant Krutna a non-exclusive, worldwide, royalty-free licence to host, process, reproduce, and transmit User Content only as needed to operate, secure, and improve the Service and to follow your instructions.

You confirm that you have the rights and lawful basis needed to provide User Content and third-party contact data to Krutna. You are responsible for what you publish and for complying with privacy, intellectual-property, advertising, and anti-spam laws that apply to your use.

A public card or shared QR code/link may be accessible to anyone who receives or discovers it. Recipients may save or copy information outside Krutna. Updating or deleting a card cannot remove copies already stored by recipients or third-party services.

4. Acceptable use

You must comply with the Krutna Acceptable Use Policy at /legals/acceptable-use-policy. You may not misuse the Service, interfere with its security or availability, access accounts or data without permission, scrape or harvest data, send spam, impersonate others, infringe rights, or use Krutna for unlawful or harmful activity.

We may investigate suspected misuse and remove content, restrict features, suspend accounts, or terminate access where reasonably necessary to protect Krutna, users, third parties, or the Service, or to comply with law.

5. Paid plans, Paddle, and taxes

Plan features, billing intervals, prices, and any usage or seat limits are shown on /pricing or in the checkout before purchase. Unless stated otherwise, subscriptions renew automatically for the same billing period until cancelled.

Paddle is the authorized reseller and Merchant of Record for paid Krutna subscriptions purchased through Paddle Checkout. You purchase the subscription from Paddle, Paddle charges your payment method, issues transaction documents, and handles applicable sales taxes. Your transaction with Paddle is also governed by Paddle's Buyer Terms at https://www.paddle.com/legal/buyer-terms.

You authorize Paddle to charge recurring subscription fees and applicable taxes until cancellation. Krutna receives limited customer, subscription, transaction, and payment-method summary data from Paddle, but does not receive or store your full card number.

6. Cancellation, plan changes, and refunds

You may cancel a subscription through Krutna's billing settings or the Paddle customer portal. Unless mandatory law or the checkout states otherwise, cancellation takes effect at the end of the current paid billing period and access continues until then.

Upgrades, downgrades, billing-interval changes, and seat changes may take effect immediately or at the next renewal as displayed before confirmation. Paddle may calculate prorated charges or credits where the selected change requires them.

Refunds are governed by Krutna's Refund Policy at /legals/refund-policy and Paddle's Refund Policy at https://www.paddle.com/legal/refund-policy. Nothing in these Terms limits a mandatory consumer right.

7. Third-party services

The Service may interoperate with providers such as Google, Apple, Paddle, or other services you choose to connect. Their terms and privacy practices govern their services. Krutna is not responsible for third-party services, but this does not limit our responsibility for our own processing or obligations under applicable law.

8. AI-assisted features

Some features may use artificial intelligence to translate content, digitize business cards, or help generate text. AI output can be incomplete, inaccurate, or unsuitable. Review output before using or publishing it and do not submit sensitive or third-party data unless you have authority and a valid reason to do so.

You remain responsible for your inputs and your use of AI output. Krutna may send the minimum necessary input to an AI service provider to produce the requested result, as described in the Privacy Policy.

9. Krutna intellectual property

Krutna and its licensors own the Service, software, designs, documentation, trademarks, and other materials excluding User Content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose during your account or subscription term.

You may not copy, resell, sublicense, reverse engineer, bypass access controls, or use the Service to build a competing product except where applicable law expressly permits it.

10. Availability and disclaimers

We work to keep Krutna secure and available, but the Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted or error-free operation, permanent storage of every item, or that User Content is accurate.

These disclaimers do not exclude warranties or rights that cannot legally be excluded.

11. Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, or consequential loss, or lost profits, revenue, goodwill, or data, arising from the Service. Krutna's total liability arising from the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or USD 100.

The limitations above do not apply where liability cannot lawfully be limited, including fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory consumer rights.

12. Suspension and termination

You may stop using Krutna or delete your account subject to any organization-owner transfer and active-subscription requirements shown in the Service. We may suspend or terminate access for a material or repeated breach, unlawful activity, security risk, non-payment, or where required by law. Where reasonable, we will give notice and an opportunity to remedy the issue.

On termination, your right to use the Service ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—will survive.

13. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security, or business operations. We will post the revised Terms and update the date above. For material changes affecting existing users, we will provide reasonable advance notice unless law or an urgent operational need requires an earlier effective date.

14. General and disputes

These Terms, the Acceptable Use Policy, the Privacy Policy, and any plan-specific terms form the agreement between you and Krutna about the Service. If a provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, or sale of the Service.

Before starting formal proceedings, please contact [email protected] and allow 30 days for an informal resolution. These Terms do not deprive consumers of mandatory protections or access to courts or regulators available under applicable law. Any dispute not resolved informally may be brought before a court that has jurisdiction under applicable law.
